〔自由時報記者林良哲、陳鳳麗／綜合報導〕在派出所前放鞭炮，算不算「污辱」公署？南投縣王姓男子不滿被警方開罰單，先到廟宇偷鞭炮後，騎車到埔里鎮隆生派出所前施放，一審法院認為放鞭炮有驅魔避邪之意，不算污辱公署，二審推翻原判決，法官認為王男丟擲鞭炮是向警方示威，有挑釁犯意，並有藉此貶低公署的侮辱犯意，改判他拘役20日確定。

二審推翻原判決確定

隆生派出所所長鍾郁奇表示，王男原要到埔里警分局門口燃放，被值班警員發現，才改到位置較偏僻的隆生派出所燃放，王的舉動讓人覺得無法無天，萬一丟的是爆裂物，後果不堪設想，法院判決「應該可以讓他得到教訓」。

判決指出，王不滿被警方開罰單，去年8月間夥同一名少年先到埔里鎮「蘇府王爺」廟偷走6串鞭炮，共乘機車到隆生派出所前丟擲，一陣轟隆巨響後，派出所前煙霧瀰漫，王男兩人趁隙逃跑。

警方根據監視畫面逮捕王男，檢方依竊盜及污辱公署罪起訴，南投地院審理時，法官認為鞭炮是神話中用以驅逐名為「年」之猛獸，有驅魔避邪之意，華人社會每逢慶典節日、婚喪喜慶都會施放，不具骯髒、污穢意涵，因而到派出所前放鞭炮不算污辱公署，僅就王男偷鞭炮行為判拘役20日、緩刑2年。

不過台中高分院法官認為，王男是因不滿被開單前去派出所丟擲鞭炮，本意是向警方示威、報復，發洩心中憤恨，主觀上除有「故意惹起爭端」挑釁犯意外，更有以此貶低、減損公署名譽的侮辱犯意，故依侮辱公署罪判他拘役20日。

【陳郁仁／海地報導】海地最高法院在二零一一年的大地震中倒塌，中華民國政府現承諾提供四點七億台幣，幫助海地重建最高法院大樓。總統馬英九出訪中南美今抵達海地，他與海地總統馬德立將一同替最高法院工地舉行動土儀式。在前往動土儀式的途中，路邊突然出現一群海地人，對馬德立總統大聲歡呼；馬德立也突然走入人群，引起現場一陣騷動，馬總統順勢被擠到人群中，一起與馬德立跟海地群眾擊掌。隨護們則緊張的跟著人群中的兩國元首，深怕總統們受傷。

外交官員表示，馬德立總統在海地民意支持度高達六成，常有群眾在路邊熱情要他走入群眾，馬德立也會很親民的走進去。此外，《蘋果》詢問為何興建最高法院需要價四點七億台幣，負責興建的的海外工程公司人員說，海地物資缺乏，都依賴進口，台灣一包水泥要兩千元，海地要八千，所以興建成本較高。
