一名男子日前透過網路結識一名女網友，雙方相談甚歡，甚至還聊起性愛議題，2人甚至還當晚相約碰面發生一夜情。男子使出渾身解數，成為「一夜五次郎」，女方還允諾可以不戴套。不料事後男子被控告性侵，檢方調查後認為，女方允諾一夜情不戴套，還和對方吃消夜和早餐，不像被性侵模樣，5日做出不起訴處分。

該名34歲男子被指控在今年2月，性侵一名26歲女網友，但檢方調查發現，2人在網路上認識後，當晚就相約見面。男子將女網友帶到新北市新莊區的友人住處，當天就發生一夜情。身材壯碩的他，為證明自己勇猛，使出渾身解數，當天化身成為「一夜五次郎」，不料卻在2天後被對方控告性侵。

女方指稱雖有和男子聊性愛話題，但不代表同意和對方嘿咻；根據《蘋果日報》報導，檢方調查卻發現，2人聊天過程中，女方曾提可接受口交，還說當晚是生理期第二天，可以「不用戴套」；甚至在發生4次性關係後，2人一同外出吃消夜，再回來進行第5次，醒後又一同吃早餐。若真遭性侵早有機會呼救逃跑，但這些舉動有違常理，且隔壁室友也沒聽到呼救聲，因此不信女方說法，檢方對男方不起訴。
