文林苑王家要求原地重建　法院上午將宣判

【法庭中心／台北報導】台北市政府以公權力介入文林苑都更案，代建商樂揚建設拆除王家，王家打官司要求原地重建，台北高等行政法院上午10時30分將宣判。

北市去年3月強拆文林苑都更案不同意戶王家，引起輿論抨擊侵害人民居住權，王家為護家打的首件訴訟敗訴定讞後，大法官今年4月為此做出釋憲，認為《都市更新條例》中，屋主、地主1/10同意的門檻過低，未確實保障人民權益，已經違憲，應在1年內檢討修正。

但因文林苑都更案箭在弦上，來不及等修法，王家仍繼續對市府代拆部分提出訴訟，期間雖一度因副市長張金鶚願居間協調，而暫停訴訟，但最後宣告破局。
