醫療法修正案　醫師勞動條文今闖關失敗

【邱俊吉／台北報導】立法院今審查《醫療法》修正草案，針對醫師勞動問題，由於修正條文僅讓醫師職災補償準用《勞動基準法》規定，有立委質疑，醫師應該全面納入、而不是這樣片面套用《勞基法》，因此該條文最後闖關失敗。

立委林淑芬認為，醫師也是勞工，則其勞動問題便該由《勞基法》管理，而不是用修改《醫療法》來替醫院解套，此外，今審查的修正條文雖將醫師職災補償準用《勞基法》規範，但即使醫院不配合、硬是不願補償，則依照《醫療法》，衛生機關也只能罰院方1萬至5萬元，這對照醫師的所得與損失，實在不成比例，因此她不能接受這項修正條文。

對於該修正條文闖關失敗，衛生福利部次長林奏延說，這項條文若過關，起碼可以讓醫師勞動條件提高到60分，現在退回原點，等於是零分，他個人對此感到相當遺憾。
