騎士撞車門成植物人 駕駛判刑又賠錢

開車門要注意！新北市一名男子日前把車停好後，因為沒有注意路況就想下車，車門一開就撞上後方機車，釀成車禍，導致騎士成為植物人。台北地院以過失重傷害罪，判處有期徒刑七個月，緩刑五年，還要賠償騎士家屬一百八十萬。

判決書指出，今年5月27日上午8點多，43歲的李姓駕駛在台北市萬華區寶興街上停車後，本應在開啟車門時注意行人、車輛，但他卻疏於注意同向左側有輛機車剛好行駛而來，而沒有先行禮讓，竟直接開啟駕駛座車門而不慎撞擊到對方機車，導致騎士人車倒地受傷。騎士手術後呈現植物人狀態，李姓駕駛被以過失重傷害罪嫌起訴。

台北地院審理時，李姓駕駛坦承犯行。法院認定他觸犯過失重傷害罪，審酌李姓駕駛因疏忽造成騎士的傷害，但他犯後坦承犯行，又積極與被害者家屬達成和解，也已賠償部分和解金，考量李姓駕駛的工作、家庭狀況後，判處有期徒刑7月，宣告緩刑5年，緩刑期間除了先前賠償的40萬元外，還要再賠償180萬元。由於騎士被撞成植物人，家屬同時打民事訴訟求償1000萬元，全案還在審理中。
