假油案 產品責任險難賠

台灣假油事件連環爆。據了解，大統及富味鄉分別向華南產及明台產險投保「產品責任險」，保額分別是1,000萬及5,000萬元，目前都在保險契約有效期限中。

但產險業者指出，依「產品責任險」條款約定，若「被保險人有故意、刑事不法或故意違反正常製作程序之行為」，保險公司將可不負理賠責任。

產險業者指出，目前檢調已針對大統及富味鄉展開調查，若未來確定大統及富味鄉「假油案」，都涉及刑責，產品責任險可不予理賠。

此外，民眾若吃到假油，覺得身體不適，是可以向相關產險公司提出保險理賠請求；但產險業者說，民眾必須自行負起「舉證責任」，例如因為長期食用假油，造成「不孕」等事證。但因為舉證多半很難成立，因此，不予理賠機率很高。
