違規停車害命 賠2百萬獲緩刑

（中央社記者蔡沛琪台北11日電）陳姓騎士酒駕，為閃避林姓男子違規停在路邊的小客車而貿然轉向，卻碰撞後方騎士，致對方被貨車輾斃。台北地院予陳、林緩刑。

根據法院今天公布判決，陳姓男子在去年12月晚間，在台北市松山區幾杯黃湯下肚後，騎機車行經塔悠路一帶。陳男為躲避在交岔路口違規停車的小客車，貿然向左偏移，結果不慎與後方騎士碰撞。

被害騎士人車倒地滑行，當場被後方閃避不及的貨車輾斃。被害人家屬報警，陳男與違規停車車主林男被依過失致死等罪嫌起訴。法院審理時，兩人認罪，且各以新台幣200萬元與被害人家屬達成和解。

法官考量2人行為導致本件交通事故，被害人年輕生命消逝，審酌兩人坦承犯行，達成和解，依公共危險罪判處陳男1年2月，緩刑5年；另依過失致死罪判處林男6月徒刑，可易科罰金，緩刑3年，全案可上訴。1021011
