因為第1次遇到這種問題不是很懂想請教大家我是直行車(汽車)行駛在內線車道未超速對方是機車從機車道直接左轉我雖然有緊急剎車但還是撞上他警察局的初步判斷他占多數肇事責任(他7 我3) 對方是70歲的老爺爺當時目測僅手腳輕微擦傷最近對方申請調解出具診斷證明腰椎骨折(但沒註明要休養多久) 包含居家看護3個月10萬勞動力減損3個月13萬5000 精神撫慰24萬再加上醫療單據交通費機車修理費等一共要求50萬保險公司理賠員說醫療單據才2000 精神撫慰要24萬不成比例另外勞動力減損部分對方也沒證據可以證明所以調整尚不成立想請問大家精神撫慰金該怎麼算比較合理呢？ -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 111.246.71.18
