特偵組「監聽」民進黨立院黨團總召柯建銘涉關說一事，近來引發各界高度關注。律師郭林勇及周宇修均認為，檢調單位申請監聽成立條件嚴苛，尤其牽涉反對黨關鍵人士，勢必特別慎重；特偵組可能並未觸犯具體法規，但處理程序上瑕疵顯而易見。

高檢署特偵組6日發布新聞稿，指證在會同台北地檢署偵辦法官集體貪汙案時，在監聽立委柯建銘的過程中，發現柯疑似透過立法院長王金平及前法務部長曾勇夫，向高檢署檢察長陳守煌關說，使柯被新竹地院以背信罪起訴的案件得以不繼續上訴。消息一出社會譁然，曾勇夫為此下台，總統馬英九也針對關說一事譴責王金平，而前副總統呂秀蓮則在「臉書」質疑監聽的正當性。

柯建銘7日表示，特偵組指出監聽是從101年開始，然而新聞稿中卻紀錄貪汙案的監聽始於100年，另外他在過程中也從未收到法院通知書，此事涉及違法必須深究。

根據「通訊保障及監察法」第27條，執行機關應於通訊監察結束後於7日內以書面呈報法院，法院審查後再視情節決定通知受監察人。以此案為例，若特偵組在9月5日偵結屬實，則柯目前未收到通知書並無違法；未來只要釐清特偵組開始監聽的真正時間即可。

曾任法務部政務次長的前立委郭林勇指出，受關說的案件本身已進入司法程序，是否適用監聽、或是另案監聽的結果是否能夠作為證據，值得商榷。「已進入訴訟階段的案件不應該被監聽。」郭林勇說，「這牽涉到法律上『對等』的問題，例如柯與律師的談話若受到監聽，內容若被檢調獲悉，勢必影響訴訟過程。」

部分媒體指稱特偵組「兩案混辦」不夠嚴謹，律師周宇修認為，這是常見且合法的情形，只要在監聽過程中發現足以構成犯罪行為的事證，法院核准後即可成立另案。但是另案監聽所得證據，是否可以挪作其他單位使用，例如特偵組將結果移交監察院，進入行政調查的階段，「這是法律上的灰色地帶。」

周宇修解釋，較常見的情形，是另案監聽之後發現其他犯罪事證，於是向法院申請延長監聽時間。柯案中因查無對價關係，不構成犯罪，則調查結果應交由主管機關，也就是行政院院長裁量，或是若監委辦案需要提出借調證據申請，都是合法且合理的作為；然而，特偵組宣布全案偵結後卻移送監察院，程序上非常罕見，勢必引起職權劃分的爭議。

依照正常程序，則高檢署檢察總長黃世銘直接向總統匯報的動作，就一樣有行政程序上的瑕疵，因為關說案其中一名關係人為曾勇夫，則黃世銘應該先向行政院長報告偵查結果為宜。

針對外界質疑，若高檢署檢察長陳守煌參與關說成立，使承辦柯案的林秀濤檢察官因此決定不再上訴，則為何特偵組報告中卻未提及林有行政疏失？周宇修指出，陳身為檢察長，若認定某案件沒有上訴必要而提出建議，不夠成違法，特偵組可能因此認定林只是採納專業建議，並無疏失。

（中央社記者程啟峰高雄8日電）2013亞太城市高峰會（APCS）明天將在高雄登場，參加會議各國代表團陸續抵台，高雄市政府也展開各式迎賓活動。

市府於7日至12日與環球購物中心新左營車站店及台鐵新左營站合作，於環球購物中心新左營台鐵大廳設置迎賓接待櫃台，讓與會貴賓一抵達高雄就能感受到這城市的熱情，並及時獲得會議與旅遊相關資訊。

APCS迎賓接待櫃台迄今已接待中國大陸天津市、廈門、美國檀香山、西雅圖、日本熊本市、八王子市等30多個姐妹市與城市代表團。

APCS迎賓接待櫃台除備有台灣味蛋黃酥、鳳梨酥及飲料接待貴賓，並提供立可拍拍照服務，貴賓可選擇穿搭原住民頭飾、背心及客家服飾、美濃紙傘等，在接待大廳背板前拍照留念。

高雄市經發局今天說，未來將長期與環球購物中心新左營車站店及台鐵新左營站合作，將環球購物中心新左營台鐵大廳作為高雄舉辦大型會展活動迎賓接待大廳，形塑成為高雄會展門戶。

另外，高雄市長陳菊今晚也出席APCS的VIP之夜，歡迎遠道而來的各國代表團。

亞太城市高峰會議9至11日在高雄巨蛋舉行，有100多個城市參與，會中將透過主題演講、市長論壇與分組座談等，探討城市治理與最佳營運策略。
