力保軍法官特權？ 軍法院聲請軍審法釋憲

因下士洪仲丘軍中枉死案，立法院今年8月修改「軍事審判法」，將非戰時軍人犯罪的多數案件轉移一般法院審理。豈料，最高軍事法院、北部地方軍事法院卻提出釋憲聲請，認為該修法有違憲之虞。對此，洪家義務辯護律師顧立雄今（21）日引用軍事法院的聲請書質疑，軍事法院抗拒修法，根本的原因是否就在想保障他們司法官的身分呢？

民進黨立委尤美女今日召開「軍法復辟？包藏私心」記者會，並邀請洪仲丘母親、舅舅與姊姊洪慈庸及義務辯護律師出席。

立委尤美女指出，雖然立法院修改了軍事審判法，但國防部最高軍事法院、北部地方軍事法院卻都向大法官會議提起釋憲聲請，認為今年8月通過的「軍事審判法」違憲。而根據大法官審理案件法第9條規定，「聲請解釋機關有上級機關者，其聲請應經由上級機關層轉，上級機關對於不合規定者，不得為之轉請，其應依職權予以解決者，亦同」。也就是最高軍事法院、北部地方軍事法院隸屬於國防部法律司之下，各級軍事法院聲請釋憲，必定經過其上級機關國防部層轉。她要求國防部出面說清楚對於釋憲聲請的態度。

顧立雄質疑，軍事法院提出許多釋憲理由，但根本的原因可能就在想保障他們所謂法官身分。其中，軍法院在釋憲聲請書指出「然因平時無案可辦，目前國防部刻正規劃檢討軍法官之加給，且精簡軍事院檢人力，職缺編配部隊，即將大部分軍法官，派遣至各部隊從事法制工作，試問？努力準備多年考上法官，並志業且信賴從事軍事審判之偵、審工作的軍法官，在完全沒有採取任何合理之補救措施，或訂定過渡期間之條款，俾減輕損害之情況下，立法院率而修正系爭規定，逕剝奪渠等從事軍事審判之權利，其法官之身分毫無保障，甚至難以比擬「精省案」的公務員或「精實案」的軍人，情何以堪！」

軍法院在釋憲聲請書中還提到，「國防部為因應戰時之需求，而有軍事院檢組織虛級化之作為，並將軍法官投入部隊從事法務工作，沒有任何獎勵疏處等任何配套作為，且可能因組織裁撤或精簡，而有前揭依法編餘，予以退伍之危險」。

顧立雄指出，大法官釋字704號解文就已經認定，軍法官不是憲法上獨立審判的法官，也沒有法官的身分保障，現在他們卻奢言應該有法官身分保障。如果他們被編派到部隊從事法治工作又有什麼不好呢？他質疑，軍事法院等組織提出釋憲案，其實只是想保障他們司法官的身分而已。

想要設計簡訊的使用者，第一步需要「選擇」一個現成或自己設計的模組；第二步「定制」，點選一下文字介面就可以開始輸入內容，動動手指點擊可自由拖動、放大縮小文字，變換字體和顏色，還可以加入貼紙或表情符號。完成編輯後就能產生動態的文字。比如想要寫一條委婉的分手簡訊，那麼 ubertxt 就可以設計出這樣一個得分為零、遊戲結束的畫面。

回收Model S？ 美國道安全局先檢測

美國電動車廠特斯拉（Tesla）自10月初以來發生了三起火燒車事件、電動轎車Model S是否應回收，傳言四起，購買特斯拉Roadster敞蓬車的好萊塢名星喬治克隆尼（George Clooney）也對該車表現「不甚滿意」，也對特斯拉的股價悲觀。特斯拉執行長穆斯克聲稱克隆尼批評多餘，Model S沒必要進行召修；但美國國道交通安全管理局（NHTSA）決進行檢測已上路的13108輛車。

穆斯克上週在CNBC轉播的紐約時報「DealBook」會議上指出，Model S召回之說純屬臆測，因為該車的失火機率是一般汽油車的五分之一。他更直言若干媒體對火燒車的報導偏離事實，更重要的是，三起意外完全沒有人員傷亡，若是汽油車根本不可能辦到。

穆斯克也批評，購用Roadster敞蓬跑車的克隆尼抱怨與報導毫無意義。他說，這抱怨像是在iPhone 5的時代嫌第一代iPhone一樣無趣。

克隆尼的抱怨是出現在《君子》（Esquire）雜誌11日出刊的網站文章，克隆尼接受專訪時表示，他是特斯拉電動車第一批客戶，買的是Roadster（已停產），且經常出現在路上拋錨的窘境。據了解，克隆尼去年已經以9.9萬美元在慈善會賣出他的Roadster。

不過，美國國道交通安全管理局指出，他們跟特斯拉在田納西州（第三起火燒車地點）出事的主管機關溝通後，傾向針對已出廠的13108輛Model S進行逐車檢測。

特斯拉的股市價格上週曾以137.80美元收盤，創下8月7日以來新低。
