【林修卉╱台北報導】明年元旦起，14萬名醫護人員（不含醫師）不再適用責任制，改採《勞動基準法》規定的法定工時，卻傳出有醫院打算取消夜診、假日門診，避免護理人員人力不足而挨罰。民進黨立委林淑芬、台灣護理產業工會、台灣勞工陣線、醫勞盟等團體今舉行記者會，呼籲勞委會加強宣導醫療保健服務業排除適用《勞基法》責任制工時，也應立即針對所有醫療院所進行全面勞動檢查，並公布違法的醫療院所。

台灣護理產業工會理事長盧孳艷說，根據統計只要護理人員工作超時，每一個班至少會有一個錯誤發生，錯誤會是一般工作的3倍，包括給錯藥、醫療技術錯誤等醫療疏失，而且超時工作的醫護人員就像酒醉的駕駛，同時也須防範醫院要求護理人員先打卡上下班再交班，規避工時問題。

衛福部醫事司司長李偉強表示，元旦排除責任制，指的是手術室、加護病房、急診等特殊單位護理人員，而門診則早已回歸正常工時，不至於造成太大影響，但目前法規並未強制力要求醫院一定要開設夜診或假日門診；若有醫院大幅關閉夜診、假日門診，衛福部將進一步瞭解，並與健保署研議採取扣減健保補助等措施。

勞委會勞動條件處專委黃維琛則說，勞委會將擴大規模、加強檢查、督促落實護理人員回歸正常工時，若違法可處2萬元到30萬元，限期不改善還可按次處罰，並公布違法醫院名單。
